CANS Communication

All use of any services provided by CANS Communication Co., Ltd. is at all times subject to this policy and agreement. If any customer or end user violates or fails to comply with this Acceptable Use Policy, the service provider reserves the right to suspend or terminate the service immediately without prior notice. In such cases, the customer shall not be entitled to claim any damages or compensation from the service provider.

1. Purpose and Scope

This policy and agreement define the rules, conditions, and terms for using all services under the CANS Cloud Platform provided by CANS Communication Co., Ltd., exclusively for corporate or organizational customers. By accessing or using any service or system, the customer acknowledges and agrees to be bound by this policy in all respects.

2. General Principles of Use

The customer agrees to use the services solely for internal organizational purposes and not for any unlawful, disruptive, or immoral activities. The customer must comply with all applicable laws, including but not limited to computer crime laws, personal data protection laws, and regulations issued by the National Broadcasting and Telecommunications Commission (NBTC), as well as all relevant legal requirements.

The customer may allow others to use the service under their control, but remains fully responsible for all such users’ actions as if they were their own.

3. Prohibited Uses

In addition to any prohibited uses specified in other agreements between the customer and the service provider, the customer must not use the service, including any devices, systems, networks, or user accounts associated with the service, for the following purposes:

3.1 Illegal Activities

The customer must not engage in any activity that violates applicable laws, regulations, or rules, whether under Thai law or foreign jurisdictions, including laws related to communication recording, NBTC regulations, telemarketing laws, unfair advertising, or unauthorized business operations.

3.2 Auto-dialing; Trunking; Traffic Pumping

The customer must not use automated dialing systems, predictive dialing, or any software-based call management system in an unauthorized or unlawful manner. Forwarding service numbers to multi-line systems, PBX systems, or auto-answering systems is prohibited unless explicitly authorized in writing. Artificially inflating call traffic or generating unreasonable call volumes is also prohibited.

3.3 Minors

The customer must not exploit or harm minors, distribute inappropriate content to minors, or collect personally identifiable information of minors without legal consent from a guardian.

3.4 Interference; Transmit Viruses

The customer must not interfere with, disrupt, damage, or compromise the security of the service or network, whether intentionally or unintentionally. The customer must not transmit any data containing viruses, malware, spyware, trojans, worms, or any malicious software.

3.5 Objectionable or Misleading Activity

The customer must not engage in obscene, abusive, threatening, harassing, defamatory, fraudulent, or harmful conduct. Caller ID spoofing, falsifying headers, or misrepresenting identity or origin of communication without authorization is prohibited.

3.6 High-Risk Environment Use

The service must not be used in hazardous environments requiring fail-safe systems, including but not limited to nuclear facilities, aircraft systems, air traffic control, medical life-support systems, or weapon systems.

3.7 Harvest Information; Spam; Bulk Messages

The customer must not collect data without consent or send unsolicited bulk messages, advertisements, or communications that cause nuisance or disturbance.

3.8 Excessive or Unauthorized Use

The customer must not use the service beyond reasonable business limits, continuously without interruption, or in a way that impacts service quality for other users.

3.9 Circumvent Compliance or Security

The customer must not attempt to bypass service limitations, security systems, or compliance mechanisms, or violate applicable laws.

3.10 Interception

The customer must not input or transmit data that may damage systems, hardware, or software of the provider, third parties, or other customers, including unlawful or unauthorized data.

3.11 Resale Prohibited

The customer must not resell, sublicense, assign, or transfer the service or any part of it to third parties without explicit written consent from the service provider.

3.12 High Risk Use Prohibited

The customer agrees not to use the service in activities where failure could result in serious injury, death, loss of life, or significant property or environmental damage.

4. Account Management

The customer is responsible for maintaining the security of all user accounts and passwords. The customer must not disclose credentials to unauthorized parties and must immediately notify the provider of any suspected unauthorized access or security breach. The customer is responsible for all activities under their account.

5. Data Protection and Privacy

The customer must strictly comply with personal data protection laws and obtain explicit consent before recording, collecting, using, or disclosing personal data. The customer is solely responsible for any violations related to data privacy. The provider bears no responsibility in such cases.

6. Fair Use Policy

The customer agrees to use the service under fair and reasonable use principles. Even if services are labeled as “unlimited,” usage must remain within normal business boundaries.

Excessive or abnormal use includes large-scale campaigns, high-frequency bulk messaging, or usage significantly exceeding the customer’s average over the previous three months. Customers must notify the provider in advance if usage is expected to increase significantly.

Failure to notify and excessive usage may be considered intentional violation. The provider may impose limits, additional charges, suspension, or termination without prior notice.

7. Right to Review Use, Suspension and/or Termination

The provider reserves the right to monitor and evaluate service usage at any time to ensure compliance with applicable laws and service standards. If abnormal usage patterns or violations are detected, the provider may suspend or terminate the service, including telephone numbers, immediately without prior notice.

8. Limitation of Liability

The provider operates as a licensed telecommunications provider under Thai law and complies with NBTC standards. The provider shall not be liable for:

  1. Misuse or unlawful use of services by the customer
  2. Force majeure events (e.g., natural disasters, war, outages)
  3. Failures caused by third-party systems or external factors
  4. Indirect damages, including loss of profit or business opportunities
  5. Service interruptions or signal quality issues beyond control

Maximum liability is limited to the service fees related to the incident.

9. Policy Changes

The provider may modify this policy with at least 30 days’ prior notice.

10. Violations

The provider has sole discretion to interpret this policy and determine whether a violation has occurred.

11. Governing Law

This policy is governed by Thai law. In case of disputes, Thai law shall prevail.
